Contractele de transmitere în arendă a terenurilor cu destinație agricolă proprietate privată de către APL se vor ține într-un registru special

 

Va fi prevăzut un registru al contractelor de arendă referitor la transmiterea în arendă a terenurilor cu destinație agricolă proprietate privată de către autoritățile administrației publice locale. Cu conținutul acestui registru urmează a fi completată Hotărârea Guvernului nr. 228/2019 pentru aprobarea Regulamentului privind modul de ținere a registrelor contractelor de arendă. Proiectul de modificare al HG nr.228/2019 a fost examinat în cadrul ședinței secretarilor generali.

 

Astfel, Registrul va conține informații privind: data cererii de înregistrare, acordul adițional, părțile contractante, domiciliul ori sediul acestora, bunul agricol arendat (destinația și modul de folosință), numărul cadastral, suprafața (ha), nota de bonitate, termenul arendei, plătitorul impozitelor aplicate asupra bunului agricol arendat și cuantumul plății de arendă pentru terenul neîntreținut (lei).

 

După cum se argumentează în nota informativă, Registrul este necesar în scopul executării prevederilor art. 36 din Codul funciar nr. 22/2024 ce ține de transmiterea în arendă a terenurilor cu destinație agricolă proprietate privată de către APL. Astfel, în conformitate cu pct. 26 din HG nr. 688/2024 pentru aprobarea Regulamentului privind modul de transmitere în arendă a terenurilor cu destinație agricolă proprietate privată de către autoritatile administrației publice locale, contractul de arendă pentru terenurile cu destinație agricolă proprietate privată se înregistrează în registrul ținut de primăria localității în a cărei rază teritorială se află terenul neîntreținut arendat. În acest sens, este necesară instituirea unui registru separat în acest scop, pentru a fi o evidență separată a terenurilor nelucrate care vor fi transmise în folosință de către APL.
