ASP va comunica informația despre persoanele juridice și Consiliului Concurenței

Agenția Servicii Publice va prezenta Consiliului Concurenței, pe suport de hârtie sau în formă electronică, informaţia din Registrul de stat privind înregistrarea, reorganizarea sau lichidarea persoanei juridice sau a întreprinzătorului individual, precum şi privind modificările din actele de constituire ale acestora, în termen de 3 zile lucrătoare de la data înregistrării. Cabinetul de miniștri a aprobat proiectul hotărârii de Guvern cu privire la aprobarea proiectului de lege pentru modificarea art. 37 alin. (11 ) din Legea nr. 220/2007 privind înregistrarea de stat a persoanelor juridice și a întreprinzătorilor individuali. După cum a explicat ministrul Justiției, Fadei Nagacevschi, în urma modificărilor Consiliul Concurenței, în cazul în care constată anumite elemente de concentrare economică, va putea comunica despre acest fapt organului înregistrării de stat, pentru ca împreună să poată reacționa în sensul evitării anumitor riscuri pentru circuitul economic al țării. În prezent, conform art. 37 din Lege, aceste informații sunt prezentate Casei Naţionale de Asigurări Sociale, Companiei Naţionale de Asigurări în Medicină, Biroului Naţional de Statistică şi Serviciului Fiscal de Stat. Modificarea ce urmează a fi operată la Legea nr. 220/2007 este condiţionată de obligaţiile ce rezultă din cadrul legal privind domeniul concurenţei. Consiliul Concurenţei este competent în a declara o operaţiune de concentrare economică notificată ca fiind compatibilă sau incompatibilă cu mediul concurenţial după examinarea notificării depuse de către părţile tranzacţiei.
