IALS21 și CET18, modificate

Începând cu perioada fiscală 2021, codul fiscal al soţului (soţiei) se va indica în forma IALS21 doar în cazul în care angajatul beneficiază de scutirea majoră pentru soţ (soţie). Astăzi, 23 aprilie 2021, în MO a fost publicat Ordinul nr. 63 din 20 aprilie curent cu privire la modificarea unor ordine ale Ministerului Finanțelor. Documentul vizează ajustarea prevederilor ordinelor aprobate anterior la modificările legislației puse în aplicare din 1 ianuarie 2021.
 
Astfel, intervin modificări în Ordinul nr.95/2020, prin care a fost aprobat formularul tipizat (Forma IALS21) „Nota de informare privind salariul și alte plăți efectuate de către angajator în folosul angajaților, precum și plățile achitate rezidenților din alte surse de venit decât salariul și impozitul pe venit reținut din aceste plăți” și modul de completare a acesteia, ținând cont de excluderea, începând cu anul curent, a dreptului de utilizare a scutirii personale de către soț/soție (modificări la art.34 alin.(1) din Codul fiscal). Respectiv, din formular va fi exclusă col.10, fiind posibilă indicarea, în col.14, a codului fiscal al soţului (soţiei) doar în cazul în care angajatul va beneficia de scutirea majoră pentru soţ (soţie).
 
Totodată, din Modul de completare a formularului IALS21 este exclus indicatorul „în coloana 10”, cu renumerotarea coloanelor succesive, și completarea cu prevederea că în coloana 15 se va indica suma contribuției de asigurări sociale de stat obligatorii reținute în perioada fiscală de gestiune, permise spre deducere conform art.36 alin.(7) din Codul fiscal.
 
Ținând cont de noile prevederi ale art.34 alin.1 din CF, sunt necesare modificări și în Declarația CET18. Respectiv, la poziția D7, începând cu perioada fiscală 2021, contribuabilii vor indica „Total scutiri ((D1 sau D2) +D4 + (D5+D6)”, iar poziția D3 (suma scutirii utilizate pentru soţ/soţie, cu condiţia că soţul/soţia nu beneficiază de scutire personală) nu se va mai completa.
