Membrii organelor colegiale de conducere vor fi trași la răspundere pentru nerespectarea legii

Ministerul Justiției a elaborat un proiect de lege care va permite tragerea la răspundere a membrilor organelor colegiale care au adoptat decizii ilegale sau au comis alte abateri de la lege. Astfel, proiectul de lege va institui cadrul juridic de reglementare al mecanismului facilitat de identificare a persoanelor responsabile pentru deciziile adoptate de către organele colegiale ale entităților publice și private. Autorii menționează că scopul constă în crearea unui cadru juridic pentru stabilirea răspunderii membrilor organelor colegiale pentru investigarea și tragerea la răspundere juridică a membrilor organelor colegiale pentru deciziile luate în executarea obligaţiilor care intră în atribuţiile acestora potrivit legislaţiei, contractului sau statutului. Documentul prevede şi completarea Codului contravenţional al Republicii Moldova. Și anume, tragerea la răspundere a conducătorului entităţii publice/preşedintelui organului colegial în cazul neconvocării sau neorganizării ședinței organului colegial, pentru situațiile în care nu convoacă sau nu asigură organizarea ședinței în termenul prevăzut de lege, făcând să intervină prezumţia legală a aprobării tacite, în cazurile prevăzute de lege. Astfel, aceștia vor fi sancţionați cu amendă de la 50 la 150 de unităţi convenţionale. Dacă se va constata, însă, că aceste acțiuni au cauzat prejudicii considerabile, conducătorul entităţii publice/preşedintele organului colegial va fi sancționat cu amendă de la 100 la 250 u.c. cu privarea de dreptul de a deţine o anumită funcţie sau de dreptul de a desfăşura o anumită activitate pe un termen de la trei luni la un an. Deci, indiferent de circumstanţe, membrii organului colegial trebuie să poarte răspundere pentru deciziile luate. Proiectul de lege vine să excludă interpretările ambigue şi discreţionare în privinţa instituirii răspunderii membrilor organelor colegiale. Răspunderea colectivă trebuie să funcţioneze şi membrii organului colegial urmează să răspundă pentru deciziile luate în executarea obligaţiilor care intră în atribuţiile acestora potrivit normei legale.
