НБМ предложил продлить срок ликвидации банков до 5 лет

Национальный банк Молдовы предложил продлить срок ликвидации банков с 3 до 5 лет и проводить исключение их из Государственного регистра с уведомлением НБМ, информирует МОЛДПРЕС. Предложения содержатся в вынесенном банком на открытое обсуждение проекте по внесению изменений и дополнений в некоторые законодательные акты. "Исключение находящихся в процессе ликвидации банков из Госрегистра Регистрационной палаты выполняется по общим правилам об исключении юридических лиц, которые ликвидируются добровольно (по решению учредителей) или на основе судебных решений", - говорится в прилагаемой к проекту пояснительной записке. Эти правила, по мнению НБМ, "не всегда применимы к банкам в процессе ликвидации" У ликвидации банков есть свои особенности. Процесс может быть инициирован Нацбанком, который назначает ликвидатора, уполномоченного надзирать над активами банка. НБМ утверждает ликвидационный баланс и отчет о завершении процесса ликвидации. Авторы проекта предлагают, чтобы исключение из Госрегистра банков в процессе принудительной ликвидации осуществлялось по запросу об исключении, поданному ликвидатором; решению Нацбанка об утверждении отчета о ликвидации банка; ликвидационному балансу. В настоящее время в процессе ликвидации находится восемь банков, чьи лицензии были ранее отозваны НБМ. Период ликвидации для трех банков был продлен на шесть месяцев, для пяти - на год. Даже при этом, отмечает Нацбанк, исходя из реальной ситуации, ликвидаторы не уложатся в указанные сроки. Ликвидаторы банков сталкиваются с различными проблемами, связанными с оценкой и продажей активов (в том числе задолженности), судебными разбирательствами, исполнением исполнительных листов, ходом процедур по несостоятельности должников.
