Noi prevederi în Codul fiscal

Deducerea provizioanelor destinate acoperirii eventualelor pierderi ce ţin de nerestituirea creditelor nebancare şi neachitarea dobânzilor aferente şi acoperirii creanţelor ce ţin de nerecuperarea ratelor şi a dobânzilor de leasing financiar este permisă și organizaţiilor de creditare nebancară. Limita provizioanelor va fi calculată conform regulamentelor Comisiei Naţionale a Pieţei Financiare. În Monitorul Oficial a fost publicată Legea nr.23 pentru modificarea unor acte legislative din 27 februarie curent, care prevede modificări și completări la un șir de acte legislative ce țin de activitatea organizațiilor de creditare nebancară, birourilor istoriilor de credit, de asigurare etc., iar normele indicate supra sunt incluse în Codul fiscal. Tot vineri, 20 martie 2020, în MO este publicată și Legea nr. 26 pentru modificarea unor acte legislative, care intervine în art.20 z7) din CF. Amintim că actuala redacție a acestui punct indică că plata depozitelor garantate din Fondul de garantare a depozitelor în sistemul bancar, conform Legii nr.575-XV din 26 decembrie 2003 privind garantarea depozitelor persoanelor fizice în sistemul bancar este venit neimpozabil. Noua redacție prevede excluderea restricției ce ține de neimpozitarea acestor plăți doar pentru persoanele fizice. În același timp, sintagma „persoane fizice” este exclusă și din art.31 alin.5 din CF. Astfel, băncilor admise şi obligate de Banca Naţională a Moldovei să participe la formarea mijloacelor Fondului de garantare a depozitelor în sistemul bancar li se permite de a efectua deduceri ale vărsământului obligatoriu anual, contribuţiilor iniţiale, trimestriale şi speciale ale băncilor în Fondul menţionat, stabilite prin Legea nr.575-XV din 26 decembrie 2003 privind garantarea depozitelor în sistemul bancar. Ambele modificări vor intra în vigoare peste 6 luni din data publicării.
