Suplimentul de solidaritate și reexaminarea pensiei de dizabilitate

Modificările operate prin  Legea nr. 127/2021 au introdus la sistemul public de pensii suplimentul de solidaritate, care este definit ca diferența dintre cuantumul pensiei calculate și cuantumul pensiei minime pentru categoria respectivă de prestație. Pentru punerea în aplicare a noilor prevederi, Guvernul a aprobat în ședința de astăzi, 8 decembrie, proiectul hotărârii cu privire la modificarea Regulamentului privind modalitatea de calculare a pensiilor și modalitatea de confirmare a stagiului de cotizare pentru stabilirea pensiilor, aprobat prin HG nr. 165/2017.
 
Astfel, se precizează că, în cazul în care pensia calculată în condițiile unui stagiu de cotizare incomplet este sub nivelul pensiei minime, asiguratului i se acordă pensia calculată, care nu poate fi mai mică decât pensia minimă diminuată proporțional stagiului de cotizare realizat, dar nu mai mică de 50% din pensia minimă.

 

Regulamentul ar urma să fie completat cu o secțiune nouă ce va reglementa calcularea pensiei de dizabilitate pentru pensionarii care activează în câmpul muncii după realizarea dreptului la pensie. Deci, pensionarii care activează sau au activat în câmpul muncii după realizarea/reexaminarea dreptului la pensie de dizabilitate pot solicita reexaminarea pensiei nu mai des decât o dată la doi ani, cu condiția că pensia calculată după reexaminare este mai mare decât cea aflată în plată. Această prevedere se va aplica după finalizarea procesului de reexaminare a pensiilor de dizabilitate stabilite până la 1 ianuarie 2022, conform eșalonării prevăzute.

 

Astfel, de la 1 ianuarie 2022 vor fi reexaminate pensiile de dizabilitate stabilite până la 1 ianuarie 1999, cu condiția confirmării stagiului de cotizare de la 2 ani după realizarea dreptului la pensia de dizabilitate.

 

Reexaminarea pensiilor de dizabilitate stabilite după 1 ianuarie 1999 și până la 1 ianuarie 2022 va fi efectuată la 1 ianuarie 2023, cu condiția confirmării stagiului de cotizare de la 7 ani după realizarea dreptului la pensie de dizabilitate, iar la 1 ianuarie 2024 – pensiile de dizabilitate pentru persoanele care au activat în câmpul muncii de la 2 până la 7 ani după stabilirea dreptului la pensia respectivă.

 

Noile drepturi la pensie se vor acorda începând cu luna următoare celei în care au fost depuse cererea și actele necesare la organul de asigurări sociale.
