Comisia Europeană cere Irlandei să recupereze de la Apple până la 13 mlrd. euro din impozite neplătite

Comisia Europeană a cerut Irlandei să recupereze de la grupul informatic american Apple impozite neplătite pentru perioada 2003-2014 în valoare de până la 13 mlrd. euro, plus dobânzi, în contul unor “facilități fiscale” de care a beneficiat grupul american din partea autorităților irlandeze. “Statele membre nu pot oferi facilități fiscale anumitor companii, acest lucru este ilegal conform prevederilor UE privind ajutoarele de stat. Investigația Comisiei a ajuns la concluzia că Irlanda a acordat Apple facilități fiscale ilegale, care au permis acestei companii să plătească taxe semnificativ mai mici decât alte companii timp de mai mulți ani. Grație acestui tratament preferențial, Apple a plătit în realitate un profit pe companii care a scăzut de la 1% pentru profiturile sale europene în 2003 până la 0,005% în 2014”, a declarat comisarul european pentru Concurență, Margrethe Vestager. Executivul comunitar a precizat că, în urma unei investigații demarate în luna iunie 2014, s-a descoperit faptul că profiturile din vânzările realizate de subsidiarele Apple Sales International și Apple Operations Europe, companii cu sediul în Irlanda, erau alocate „într-o modalitate care nu corespunde cu realitatea economică”. Astfel, majoritatea profiturilor generate de Apple în Europa erau alocate unor „head offices” care existau doar pe hârtie și care nu plăteau taxe nicăieri. În concluzie, CE a cerut Irlandei să recupereze de la Apple impozite neplătite pentru perioada 2003-2014. În replică, Irlanda a anunțat că intenționează să facă recurs la decizia CE. Ministrul irlandez de finanțe, Michael Noonan, a subliniat că poziția autorităților de la Dublin este în continuare aceea că Irlanda nu a acordat un tratament preferențial Apple și nici nu a acordat ajutoare de stat. “Decizia CE nu îmi lasă altă opțiune decât să cer aprobarea Cabinetului pentru un recurs. Acesta este necesar pentru a apăra integritatea sistemului nostru fiscal, pentru a oferi certitudine fiscală companiilor și a contesta uzurparea de către prevederile comunitare privind ajutoarele de stat a competenței suverane a statelor membre în domeniul taxelor”, a declarat Michael Noonan. Taxele sunt un domeniu care ține de competența statelor membre UE însă Comisia consideră că poate interveni acolo unde facilitățile fiscale constituie ajutoare de stat, un domeniu reglementat de Executivul comunitar. De exemplu, anul trecut Comisia Europeană a ordonat Olandei și Luxemburgului să recupereze taxele datorate de grupul auto italian Fiat și grupul american Starbucks.
