Regulile de implementare a prețurilor de transfer. Proiectul propus pentru consultări

 

Ministerul Finanțelor a propus pentru consultări publice proiectul Ordinului cu privire la aprobarea regulilor de implementare a prețurilor de transfer. Proiectul poate fi consultat aici.

 

Prin acest proiect se propune aprobarea:

  • Regulamentului privind prețurile de transfer
  • Modelului Informației privind prețurile de transfer
  • Instrucțiunii de completare a Informației privind prețurile de transfer
  • Nomenclatorului statelor
  • Nomenclatorului tranzacțiilor
  • Nomenclatorului metodelor de stabilire a prețurilor de transfer
  • Nomenclatorului marjelor/indicatorilor economico-financiari de profitabilitate

 

Precizăm, începând cu 1 ianuarie 2024,  în legislația fiscală națională se propune a fi aplicat principiul prețurilor de transfer. Principiul prețurilor de transfer prevede că, contribuabilul care încheie tranzacții cu persoane afiliate cu o valoare totală pe parcursul unei perioade fiscale, calculată prin însumarea valorii tranzacțiilor efectuate cu toate persoanele afiliate, fără TVA, egală sau mai mare de 20 mil. lei, este obligat să întocmească și să prezinte informația privind prețurile de transfer, iar dacă valoarea tranzacțiilor este egală sau mai mare de 50 mil. lei, pe lângă informația respectivă, este obligat să prezinte și dosarul privind prețurile de transfer.

 

 

La stabilirea formării prețului de transfer conform principiului lungimii brațului pentru tranzacțiile desfășurate între persoane afiliate vor fi utilizate următoarele metode:

  • Metoda comparării prețurilor;
  • Metoda prețului de revânzare;
  • Metoda cost plus;
  • Metoda marjei tranzacționale nete;
  • Metoda împărțirii profitului;
  • Orice altă metodă recunoscută în Liniile directoare OCDE privind prețurile de transfer.

 

Amintim, pe platforma Ministerului Finanțelor, în cadrul Grupului de lucru nr.2 „Implementarea conceptului prețurilor de transfer” la ultima ședință ce a avut loc la 22 septembrie curent a fost prezentat proiectul Ordinului Ministrului Finanțelor cu privire la aprobarea regulilor de implementare a prețurilor de transfer.
